By accessing or using DigArt ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

DigArt is a platform that allows digital artists and creators to create a single, shareable profile showcasing their NFT collections and social links, powered by their crypto wallet.

3. User Accounts

3.1 Account Creation

• You must connect a crypto wallet (e.g., MetaMask) to create an account
• You must choose a unique username (3-30 characters, lowercase letters, numbers, hyphens, underscores)
• You are responsible for maintaining the security of your wallet
• You must be at least 18 years old to use the Service

3.2 Account Responsibilities

• You are responsible for all activity under your account
• You must not share your wallet private keys
• You must notify us immediately of any unauthorized use
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Acceptable Use

4.1 You May:

• Create a profile showcasing your digital art and NFT collections
• Add custom links to your social media and websites
• Use Auto-Discovery to find your NFT collections
• Share your profile link (digart.io/username) publicly

4.2 You May Not:

• Use the Service for any illegal or unauthorized purpose
• Upload content that is offensive, defamatory, or infringes rights of others
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated tools to scrape or harvest data from the Service
• Impersonate another person or entity
• Spam, harass, or abuse other users
• Attempt to manipulate or game the platform (e.g., username squatting for resale)

5. Content and Intellectual Property

5.1 Your Content

• You retain ownership of all content you upload (profile information, images, links)
• By using the Service, you grant us a license to display your content publicly on your profile
• You represent that you have the right to use all content you upload
• You are responsible for ensuring your content does not infringe third-party rights

5.2 NFT and Blockchain Data

• NFT collection data is sourced from public blockchains via Alchemy
• We do not claim ownership of your NFTs
• Displaying NFT collections on your profile does not transfer ownership
• ENS data is imported from public ENS records

5.3 DigArt Platform

• DigArt, including all text, graphics, logos, and code, is owned by us
• You may not copy, modify, or distribute our platform without permission

6. Privacy

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

7. Disclaimers and Limitations of Liability

7.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

7.2 No Liability for Blockchain Issues

• We are not responsible for blockchain network issues (gas fees, transaction failures, etc.)
• We are not responsible for loss of wallet access or private keys
• We are not responsible for inaccurate blockchain data from third-party APIs (Alchemy, ENS)

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

8. Account Termination

8.1 By You

You may delete your account at any time by contacting us at hi@digart.io. Upon deletion, your profile will no longer be publicly accessible.

8.2 By Us

We reserve the right to suspend or terminate your account if you violate these Terms or engage in harmful behavior. We will provide notice when reasonably possible.

9. Rate Limiting

To ensure fair use and prevent abuse, we implement rate limiting on certain endpoints:

• Username claims: 10 requests per minute
• Username checks: 30 requests per minute
• Auto-Discovery: 5 requests per minute (resource-intensive)

Excessive requests may result in temporary or permanent suspension.

10. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or a notice on the platform. Continued use after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Germany.
